The rules for using the Publinov service
This is an English translation provided for convenience. The French version is the legally binding reference.
1. Purpose and acceptance
These Terms of Use (hereinafter the "Terms") define the terms and conditions for using the Publinov service (hereinafter the "Service"), accessible at https://publinov.com.
The Service is published by ITROPIX (hereinafter the "Publisher"). See the legal notice for full details.
Registration for the Service implies full and unreserved acceptance of these Terms. The user acknowledges having read and accepted the Terms without reservation.
2. Description of the service
Publinov is an automated social media content generation platform for professionals, freelancers and small businesses.
The Service notably offers the following features:
- Generation of multi-platform publishing calendars (Instagram, Facebook, TikTok, LinkedIn, YouTube, Pinterest, X, Threads)
- Creation of text content personalised to the user's brand
- Generation of visuals (images, carousels) by artificial intelligence
- Generation of short videos (Reels, TikTok, Shorts) by artificial intelligence
- Storage of the brand and generation history
- Management of an editorial calendar with analysis of the best times to publish
3. Registration and user account
3.1 Registration conditions
Registration is open to any natural person of legal age or legal entity acting for professional purposes. The user undertakes to provide accurate and up-to-date information.
3.2 Identification
Registration and authentication are handled by the third-party service Clerk. The user can register via email/password or Google authentication. See the Privacy Policy for data processing.
3.3 Account security
The user is solely responsible for keeping their credentials confidential. Any activity carried out from their account is deemed to have been performed by them. In the event of unauthorised use, the user must inform the Publisher immediately.
4. Credit system and subscriptions
4.1 Credits
Use of the Service is based on a credit system. Each content generation uses a number of credits depending on the content type:
- Text: 10 credits
- Image: 20 credits
- Carousel: 50 credits
- Video: 120 credits
4.2 Subscription plans
The Service offers three plans:
- ๐ Free: 80 credits, images on Instagram, 1 network (Instagram), 1 week
- ๐ Creator (โฌ39/month): 800 credits, images and carousels, 4 platforms, 4 weeks
- ๐ Pro (โฌ99/month): 2,500 credits, videos included, 8 platforms, 8 weeks
4.3 Additional credit packs
The user can purchase additional credits at any time:
- Pack S: 160 credits โ โฌ9
- Pack M: 540 credits โ โฌ29
- Pack L: 1,580 credits โ โฌ79
Additional credits purchased are non-refundable but can be combined with the monthly plan credits and carried over from one month to the next.

5. AI content generation
5.1 Technologies used
The Service uses generative artificial intelligence technologies to produce personalised texts, images and videos. Content is generated from the information provided by the user (product description, target audience, objective, etc.).
5.2 Original nature and limits
Although the generated content is personalised and original for each user, the user acknowledges that:
- AI may occasionally produce imperfect, inconsistent results or results requiring editing
- The user is the sole judge of the quality and relevance of the generated content
- The user is invited to review and adapt the content before publishing
5.3 Verification and editorial responsibility
The user remains solely responsible for the content they publish on social media. They undertake to:
- Verify the accuracy of the generated information before publishing
- Ensure the content complies with applicable laws and the terms of each platform
- Not publish defamatory, illegal or misleading content
5.4 No exclusivity of content
As content is generated by artificial intelligence from parameters that may be common to several users, the Publisher does not guarantee its unique or exclusive nature. Similar or comparable content may be generated for other users. The user takes this into account in how they use the content.
5.5 Accuracy of generated information
Generated content may contain factual inaccuracies. It is the user's responsibility to verify all information (figures, claims, product features, legal notices) before publishing. The Publisher cannot be held liable for the consequences of publishing inaccurate content.
6. Intellectual property
6.1 Rights over generated content
All content generated by the Service belongs to the user, who may use it freely, including for commercial purposes.
The Publisher claims no copyright over the texts, images and videos generated by the user through the Service.
6.2 Rights over the platform
The Publinov platform itself (interface, source code, graphic design, brand, logo) remains the exclusive property of the Publisher. Any unauthorised reproduction is prohibited.
6.3 Licence granted to the Publisher
The user grants the Publisher a non-exclusive licence, limited to the duration of use of the Service, to store and process the generated content, solely for the purpose of operating the Service (brand memory, history, etc.).
6.4 Copyright eligibility
The Publisher transfers to the user all rights it may hold over the generated content. The user is however informed that, in certain jurisdictions, content generated exclusively by artificial intelligence, without sufficient human creative input, may not be eligible for copyright protection. The Publisher does not guarantee the protectability of the generated content.
6.5 Warranties on elements provided by the user
The user warrants that they hold all rights (intellectual property, trademark rights, image rights) over the elements they provide to the Service โ in particular descriptions, product visuals, logos and trademarks. They indemnify the Publisher against any third-party claim relating to these elements.
7. User obligations
The user undertakes to:
- Use the Service in accordance with its purpose and in good faith
- Not generate unlawful, hateful, defamatory or pornographic content, or content infringing the rights of third parties
- Not attempt to circumvent the technical limits of the Service
- Not use the Service to generate misleading or fraudulent content or content infringing trademarks without authorisation
- Comply with the terms of the social platforms on which they publish
- Not share their account with third parties
8. Availability and maintenance
The Publisher endeavours to keep the Service accessible 24/7. However, interruptions may occur for maintenance, updates or force majeure.
The Publisher cannot be held liable for interruptions related to third-party providers (Anthropic, Clerk, Stripe, BytePlus, host, etc.).
9. Liability
9.1 Best-efforts obligation
The Publisher acts under a best-efforts obligation, not an obligation of result. It cannot guarantee that the Service will exactly meet the user's specific expectations.
9.2 Limitations of liability
The Publisher cannot be held liable for:
- Indirect damages (loss of opportunity, loss of image, loss of profit)
- Consequences resulting from misuse of the generated content
- Commercial decisions made by the user based on the generated content
- Temporary unavailability of the Service or third-party services
- Content published by the user on social media
9.3 Liability cap
In any event, and except in the case of gross or wilful misconduct, the Publisher's total liability is limited to the amount paid by the user over the last 12 months.
10. Suspension and termination
10.1 Termination by the user
The user may cancel their subscription at any time via the Stripe customer portal accessible from their account. Cancellation takes effect at the end of the current period, in accordance with the Terms of Sale.
10.2 Suspension by the Publisher
The Publisher reserves the right to suspend or terminate a user's account in the event of:
- Breach of these Terms
- Abusive or fraudulent use of the Service
- Non-payment
- Behaviour harmful to the Publisher or other users
10.3 Data retention after termination
Generated content and history are kept for 30 days after termination, then permanently deleted. The user may request the export or early deletion of their data via the Privacy Policy.
11. Changes to the Terms
The Publisher reserves the right to amend these Terms at any time. Users will be informed of substantial changes by email at least 30 days before they take effect. Continued use of the Service after this period constitutes acceptance of the new Terms.
12. Applicable law and disputes
These Terms are governed by French law.
In the event of a dispute, the user may send a written complaint to the Publisher at contact@publinov.com. A response will be provided within 30 days.
In the event of a persistent disagreement and in accordance with Article L612-1 of the French Consumer Code, the consumer user may use a consumer mediator free of charge.
Failing an amicable resolution, any dispute will be subject to the exclusive jurisdiction of the French courts.
13. International users
13.1 Acceptance of French law
The Publinov Service is accessible worldwide. However, by registering for the Service, the user โ regardless of their country of residence โ expressly agrees that the contractual relationship is governed by French law and that the French courts have jurisdiction in the event of a dispute, without prejudice to the mandatory consumer protection rules of their country of residence.
13.2 Language of the contract
These Terms are written in French, which is the legally binding version. Translations may be provided for information purposes, but in the event of a discrepancy in interpretation, the French version prevails.
13.3 International compliance
The user is solely responsible for ensuring that use of the Service complies with the laws of their country of residence. The Publisher cannot be held liable for use of the Service in a country where it is restricted or prohibited.
13.4 Embargoed or sanctioned countries
The Service is not accessible to persons or entities located in countries subject to international embargoes or sanctions (including, without limitation: North Korea, Iran, Syria, Cuba, as well as regions under European Union sanctions).
13.5 International personal data
For users residing in the European Union, the United Kingdom or Switzerland, the processing of personal data complies with the GDPR. For other countries, GDPR standards apply by default as a minimum level of protection. See the Privacy Policy for more details.
13.6 Currency and taxes
All prices shown are in euros (EUR). Local taxes (VAT, sales tax, GST, etc.) applicable to the user's country of residence may be added to the price and are, where applicable, collected automatically by Stripe on behalf of the Publisher. See the Terms of Sale for full details.
